Warranty and Return Policy
CareRing (“the Product”) is comprised of the following components:
Insight Care Technologies Inc. (Insight) markets and warrants the Product as follows:
Within the first year after the Product is shipped Insight shall replace any Product deemed by Insight to be eligible for replacement or repair. If a Product is suspected to be defective, the Customer shall contact Insight and arrange for shipment to Insight at Insight’s cost. Should Insight determine there is no defect or that the Product is not eligible for warranty repair,the Customer shall be responsible for return shipment charges. No charge will be made to the Customer for replacement parts or for warranty repairs. The Customer’s sole and exclusive remedy for breach of this warranty is, at Insight’s option, to receive
Insight specifically disclaims any suitability for the equipment or service to serve as an emergency beacon or search and rescue system or other such telecommunications system intending to prevent loss of life. Insight hereby gives notice to the Customer and any potential End-User that, the underlying systems and techniques used in the implementation of the Product and the services are specifically commercial-best-effort systems and incorporate third party systems and services over which Insight has no control and offer no guarantee of transmission, receipt of message, or reading of or acting upon in a timely manner, any messages which may be received by any recipient or by Customer.
No warranty shall be applicable in the case of lost or stolen Product or Product destroyed or damaged outside of normal intended use.
The Product is warranted against defects in workmanship and materials for a period of one (1) year from the date of shipment, provided the Product remains unmodified and is operated under normal and proper conditions. The Warranty will continue to be in effect provided that payment of the Monthly Service Fee continues..
The above warranty provisions shall not apply to any Product (i) which has been repaired, tampered with, altered or modified, except by Insight; (ii) in which the defects or damage to such Product result from misuse, negligence, improper storage, use of parts or accessories not approved or supplied by Insight, or failure to perform operator handling and scheduled maintenance instructions supplied and/or specified by Insight and/or Customer; or (iii) ) which has been subjected to or exposed to corrosive liquids of any type or to unusual physical or electrical stress, abuse, or accident, or forces or exposure beyond normal use within the specified operational and environmental parameters set forth in the applicable product specifications. Firmware patches, bug fixes, updates or workarounds shall not extend the warranty.
EXCEPT FOR THE EXPRESS WARRANTIES STATED ABOVE, INSIGHT DISCLAIMS ALL WARRANTIES ON PRODUCTS AND SERVICES FURNISHED HEREUNDER, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE. THE REMEDY SET FORTH IN THIS SECTION IS BUYER’S SOLE AND EXCLUSIVE REMEDY FOR WARRANTY CLAIMS, AND IS EXPRESSLY IN LIEU OF ALL OTHER REMEDIES THAT MAY BE AVAILABLE TO BUYER AT LAW OR IN EQUITY.
